Terms of Use
1. Introduction and who we are
These Terms of Use govern your use of Touchtypely, the online touch typing course at touchtypely.com. When we say "we," "us" or "our," we mean the operator of the service named below. "You" means anyone who uses the service, with or without an account.
You accept these terms when you finish signing up and check the box agreeing to them. The agreement is made in English and has no fixed end date. If you try the service without an account, these terms apply to you as far as they are relevant.
Touchtypely is operated by a company based in Slovakia, a member state of the European Union. The same course is also available in Slovak under the name Prstoklad at prstoklad.sk.
The current version of these terms is always posted on this page. If you would like a copy of the version you agreed to, just ask and we will email it to you.
The service is operated by:
- Legal name: Brandrise s. r. o.
- Registered office: Sokolovská 178/10, 040 11 Košice
- Company ID (IČO): 53196449
- Tax ID (DIČ): 2121313865
- Not registered for VAT
- Commercial register: Obchodný register Okresného súdu Žilina, oddiel Sro, vložka č. 75736/L
- Email: hello@touchtypely.com
2. Your account
You can try the first lesson and the typing test without signing up. Your results are then stored only in your browser and can be moved to your account when you sign up. More lessons, saved progress, statistics and the leaderboard require an account.
To sign up, you provide an email address and a password. Right after that, you choose a first name or nickname that other people will see. Until you choose one, we show a neutral placeholder such as Typist 4821. Adding a city and state is optional. Signing in with Google is coming later. Please use an email address you actually check: we send your confirmation and password reset links there.
Your account is personal and may not be handed over to someone else. Keep your password to yourself. If you think someone else is using your account, change your password and let us know.
How we handle your personal data is explained in our Privacy Policy.
3. Children and teens
Touchtypely is for people 13 and older. It is not directed to children under 13, and children under 13 may not create an account. When you sign up, you confirm that you are 13 or older.
In some countries outside the United States, a higher minimum age applies to using online services without a parent's consent, up to 16 in parts of the European Union. If that applies where you live, you may use Touchtypely only with the permission of a parent or legal guardian.
Teens are welcome. We recommend using a nickname instead of a full name and thinking about whether to appear on the public leaderboard. The public profile and the leaderboard can be turned off at any time in account settings. Parents are welcome to help their teens get started and to practice alongside them.
If we learn that an account belongs to a child under 13, we will close the account and delete its data. If you believe a child under 13 has created an account, please let us know at hello@touchtypely.com. More details are in the Children's privacy section of our Privacy Policy.
4. Rules of conduct
Touchtypely only works if results reflect how you really type and everyone feels welcome. So you may not:
- cheat on tests or exercises, for example by having someone else type for you,
- paste text into exercises and tests instead of typing it,
- use bots, scripts, macros, auto-typing software or any other tool that types for you or interferes with the measurement,
- alter data sent to our servers or otherwise tamper with results,
- create extra accounts to influence the leaderboard,
- use a nickname that is offensive, vulgar, hateful, discriminatory or otherwise inappropriate, or that contains advertising or a link to another website,
- impersonate anyone else, such as a public figure, another user or us,
- give a false age or claim a parent's permission that was not given,
- disrupt the service, get around its security, overload it or scrape its content in bulk.
5. How we check results and enforce the rules
We check test results automatically. If a result looks unrealistic, for example because the speed is implausibly high, the system flags it and a person reviews it, which may include looking at the keystroke record from the test. Until the review is done, a flagged result may not appear on the leaderboard. A person, not an algorithm, always decides whether a result stays.
If you break the rules, depending on how serious it is, we may remove a result or hide it from the leaderboard, replace an inappropriate nickname with a neutral one, temporarily remove you from the leaderboard, or, for serious or repeated violations, suspend or close your account.
We will tell you when we remove a result, change your nickname or restrict your account, and we will explain why. If you disagree, write to us and we will take another look.
If you see an inappropriate nickname or other content on a public profile or the leaderboard that you believe is illegal or breaks these terms, report it to us by email at hello@touchtypely.com or through the form on our Contact page. Tell us which profile it is and why you think the content is inappropriate. We will review your report promptly.
If you find a bug that could be exploited, please do not exploit it. Tell us about it instead.
6. Public profile and leaderboard
Unless you turn it off, you have a public profile and your results appear on the public leaderboard. We only publish your first name or nickname, your city and state if you added them, and your results. We never publish your email address or other account details.
Shortly after you sign up, we may show on the website that you joined: only your first name, an approximate town based on the IP address of your first sign-in, and when it happened. If your public profile is off, you will not be shown.
You can turn off your public profile and leaderboard listing at any time in account settings. Other people will then no longer see you, and your results and statistics stay in your account.
Anything public can be viewed by anyone and, for example, saved as a screenshot. We cannot control such copies, so think about what you choose to make public.
Leaderboard rankings are based on results. We may change how the leaderboard works, for example its categories or time periods. Leaderboard positions, XP points and streaks are there to motivate you. They have no cash value and do not entitle you to any prize.
7. Content and intellectual property
The lessons, exercises, texts, graphics, software and the Touchtypely name and logo are protected by copyright and other laws. They belong to us or to authors who have allowed us to use them. When a practice text is based on another source, we credit that source.
You may use the service for your own learning, including at school or in a class. Without our permission, you may not copy, distribute or sell its content or use it to build another service.
Your nickname, city and state remain yours. By adding them, you allow us to show them with your results on your public profile and the leaderboard for as long as those are turned on.
We may use aggregate statistics that cannot identify you, such as which keys cause the most errors, to improve the course, including after your account is closed.
If you believe any content on the service infringes your rights, write to us and we will look into it.
8. Availability of the service
We are always improving Touchtypely, so we may add, change or remove features, and bugs may occur. The free plan, as described on our Pricing page, is free with no time limit.
We work to keep the service running around the clock but cannot guarantee it. It may be temporarily unavailable, for example during maintenance, updates or an outage at our hosting provider.
We back up your results regularly. If we fix a bug in a calculation, we may recalculate your statistics or leaderboard ranking.
The course is designed for typing on a physical keyboard in an up-to-date web browser. It may not work properly on phones and tablets.
If we ever decide to shut the service down, we will email you at least 30 days in advance so you can download your data.
9. Touchtypely Plus (paid plan)
Touchtypely Plus unlocks the full course, full daily training, all text genres, the final exam with a certificate and the other features listed on our Pricing page. The free plan, as described on the Pricing page, stays free.
You can buy Plus as a monthly subscription for $4.99, a yearly subscription for $29, or a one-time lifetime purchase for $99. Prices are in US dollars, and the checkout page shows the total before you pay. We are not registered for VAT, so no VAT is added.
Your purchase is complete once payment goes through. Payments are processed by Stripe, by card, Apple Pay or Google Pay. We never see or store your card details. You will get a receipt by email, and you can also find it in your account settings.
Automatic renewal: monthly and yearly subscriptions renew automatically for another period of the same length, and the renewal charge is made to your saved card on the renewal date, at the price shown on the Pricing page at the time, unless you cancel. You can cancel online at any time in account settings under Subscription, with no need to contact us. Plus then stays active until the end of the period you paid for, and you will not be charged again. Except where the law requires otherwise, we do not refund a period that has already started. The lifetime purchase does not renew.
Plus is digital content delivered online and becomes available as soon as you pay. If you are a consumer in the European Union, you normally have 14 days to withdraw from an online purchase. Before you pay, you expressly ask us to start providing Plus right away and acknowledge that you thereby lose that right of withdrawal. We confirm this by email after payment.
If Plus does not work as it should, contact us through our Contact page or at hello@touchtypely.com. We will handle your complaint without undue delay and within 30 days at the latest. Nothing in these terms limits any rights you have as a consumer under the law that applies to you, including the consumer laws of your US state.
Until the paid plan launches, using the service costs nothing, and you will only ever pay if you choose to buy Touchtypely Plus yourself.
10. Referral program
Every user has a personal referral link in the app. Anyone who signs up through it as a new user gets a discount on their first Touchtypely subscription. The person who referred them gets a discount on their next payment for every friend who completes a set number of course lessons. Referral discounts add up, to a maximum of 100% of one payment.
The current discount amounts and the number of lessons required are shown on the Refer a Friend page in the app. A change in the discount amount applies only to new referrals. Discounts you have already earned stay.
Discounts are applied automatically to your next payment. They cannot be paid out in cash, transferred to another person, or combined beyond 100% of one payment.
Rewards are only for genuine new users. Referring yourself, creating accounts to earn discounts or otherwise abusing the program breaks the rules, and we may cancel discounts earned that way.
11. Disclaimers and limitation of liability
Touchtypely helps you learn to touch type, but your results also depend on your practice. We do not guarantee that you will reach a particular speed or succeed at school, on a test or at work.
To the extent permitted by law, we are not liable for losses caused by temporary unavailability of the service, a fault in your device or internet connection, the loss of results stored only in your browser, or the content of third-party websites we link to, such as the sources of practice texts.
You are responsible for content you add to the service, such as your nickname.
These limitations do not apply to harm we cause intentionally or through gross negligence, and they do not limit any rights you have as a consumer under the law that applies to you.
12. Closing your account
You can close your account at any time with one button in account settings. That ends our agreement. Before you do, you can download your data there as a CSV file.
Once your account is closed, your public profile and your leaderboard results disappear, and we delete your data without undue delay. It may remain in backups for up to 30 days until they are automatically overwritten. Closing an account cannot be undone. For details on how long we keep data, see our Privacy Policy.
We may also close your account if you seriously or repeatedly break these terms, or in the situation described under Children and teens. If you do not sign in for 3 years, we will send you a reminder. If you still do not sign in within 30 days after that, we will close the account.
13. Changes to these terms
We may change these terms, for example when we add new features, launch the paid plan, the law changes or security requires it.
We will tell you about any material change by email or with a notice when you sign in, at least 14 days before it takes effect. If you do not agree with the change, you can close your account before that date. If you keep using the service after that, you accept the change.
We may make minor edits that do not change your rights or obligations, such as fixing a typo or updating contact details, without notice.
14. Governing law and disputes
These terms are governed by the laws of the Slovak Republic and the European Union. If you are a consumer, this choice of law does not take away the protection given to you by the mandatory laws of the country or US state where you live.
If something is not right, please contact us first by email at hello@touchtypely.com or through the form on our Contact page. We will reply to any complaint within 30 days. Most issues can be solved this way.
If we cannot resolve a dispute, it will be decided by the competent courts of the Slovak Republic. If you are a consumer, you may also bring a claim in the courts where you live if the law that applies to you allows it. We do not require arbitration, and nothing in these terms waives your right to take part in a class or collective action where the law allows it.
If you are a consumer in the European Union and we reject your complaint or do not reply within 30 days, you can ask for alternative dispute resolution under Slovak Act No. 391/2015 within one year, through the Slovak Trade Inspection (www.soi.sk, ars@soi.sk) or another body on the list kept by the Slovak Ministry of Economy. For cross-border disputes within the EU, the European Consumer Centre in Slovakia can help (www.europskyspotrebitel.sk).
If you are in the United States, you can also contact your state attorney general's consumer protection office or file a complaint with the Federal Trade Commission at reportfraud.ftc.gov.
15. Contact
Please send questions about these terms, complaints and reports of inappropriate content by email at hello@touchtypely.com or through the form on our Contact page.
These contacts also serve as our single point of contact for users and authorities under the EU Digital Services Act (Regulation (EU) 2022/2065). You can write to us in English or Slovak.
